In the Lawsuit, Plaintiff alleges that Defendant violated the Electronic Funds Transfer Act, 15 U.S.C. § 1693 et seq. (“EFTA”). The Electronic Funds Transfer Act, 15 U.S.C. § 1693 et seq. (“EFTA”) requires that an ATM operator provide notice of any ATM fee charged to consumers by (1) posting notice of the ATM fee on the outside of the ATM, AND (2) providing on-screen notice of the ATM fee charged to the consumer before the transaction is complete and before the consumer is irrevocably committed to completing the transaction. Specifically, Plaintiff alleged in the Lawsuit that Defendant violated EFTA by only providing on-screen notice of an ATM fee to consumers while neglecting to post the additional notice of the ATM fee on the outside of the ATM.
Defendant denies Plaintiff’s claims of wrongdoing, but has agreed to settle all claims against it to avoid the expense of continued legal proceedings. To see a copy of the Settlement Agreement, click here.
